Mobile Application Terms of Use

1. Acceptance of Terms
By downloading, installing, or using any of our mobile applications
or related services (each an “App,” collectively the “Services”),
you agree to be bound by these Terms of Use (“Terms”).
If you do not agree, do not use the Services.
2. License Grant
Subject to these Terms, BHT Dynamics, LLC (“we,” “us,” “our”) grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Services on devices you own or control.
3. Restrictions
You agree not to:
- reverse-engineer, decompile, or disassemble any portion of an App;
- modify, rent, lease, loan, sell, distribute, or create derivative works from an App or the Services;
- circumvent or disable any technical measures or digital-rights-management features.
4. Intellectual Property
All rights, title, and interest in and to the Services—including
all code, designs, graphics, and trademarks—remain the sole property
of BHT Dynamics, LLC or its licensors.
Nothing in these Terms transfers ownership to you.
5. User Content
Our current Services do not enable user-generated content. Should that change, you will retain ownership of anything you upload, but you will grant us a perpetual, worldwide, royalty-free license to use such content to operate and promote the Services.
6. Privacy
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to our collection and use of data as described in that policy.
7. Disclaimers & Warranties
AS IS / AS AVAILABLE.
The Services are provided “AS IS” and “AS AVAILABLE.”
We expressly disclaim all warranties—express, implied, statutory, or otherwise—
including but not limited to warranties of merchantability, fitness
for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, BHT Dynamics, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of (or inability to use) the Services.
9. Indemnification
You agree to defend, indemnify, and hold harmless BHT Dynamics, LLC and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.
10. Governing Law & Venue
These Terms are governed by the laws of the State of Texas,
excluding its conflict-of-law rules.
You consent to the exclusive jurisdiction of the state and federal
courts located in Travis County, Texas.
11. Changes to Terms
We may modify these Terms at any time.
When we do, the “Last Updated” date above will be revised.
Continued use of the Services after any change constitutes acceptance.
12. Termination
We may suspend or terminate your license and access if you violate these Terms. Upon termination you must delete all copies of any App from your devices.
